Introduction
These Terms of Service (the “Terms”) are an agreement between you and Underdog Studios Oyun Teknolojileri Anonim Şirketi, a company incorporated under the laws of the Republic of Türkiye, registered with the Ankara Trade Registry under registration number 551794, with its registered office at Ehlibeyt Mah. Tekstilciler Cad. No: 35 İç Kapı No: 7, 06520 Çankaya / Ankara, Türkiye (DUNS: 349550128) (“Underdog Studios”, “Underdog”, the “Company”, “we”, “us” or “our”).
These Terms govern your access to and use of: (i) the games made available by Underdog now or in the future (the “Games”); (ii) the websites, web pages and social media pages we operate in connection with the Games (the “Sites”); (iii) the software we provide in connection with the Games (the “Apps”); and (iv) the online services, programmes and offers available through the Games, Sites and Apps (together, the “Services”).
By creating an account, or by downloading, accessing or using any of the Services, you confirm that you have read, understood and agree to be legally bound by these Terms and any additional documents referred to in them.
Please read these Terms carefully before using the Services. They include an agreement to arbitrate disputes and a disclaimer of warranties.
To the fullest extent permitted by law, we may enforce any provision, right or remedy under these Terms at our discretion. Choosing not to enforce a provision in one case does not waive our right to enforce it in another.
The Games do not offer real-money gambling or any opportunity to win real money or real-world prizes. Nothing of monetary value can be won by playing, and no payment is required to play, although the Games may offer optional purchases of virtual items as described in Section 7.
1. Terms and binding effect
1.1Effective date. These Terms take effect on the date you accept them or, if earlier, the date we first provide the Services to you.
1.2These Terms are a legally binding agreement between you and Underdog. Depending on where you live or your nationality, some features of the Services may not be available to you. You are responsible for complying with the laws that apply to you. Being able to access the Services does not mean that using them is lawful where you are.
1.3Changes. We may update these Terms from time to time at our discretion by publishing the revised version at underdog.gs/terms. Changes take effect when published unless applicable law requires otherwise. If you continue to use the Services after the revised Terms are published, you will be deemed to have accepted them from their effective date, unless the law requires us to obtain your agreement in another way. Please check this page regularly. If you do not agree to the changes, you must stop using the Services; you will remain responsible for any amounts already due.
1.4Some services, promotions, software or content may be subject to additional terms that we specify from time to time (“Supplementary Terms”). If Supplementary Terms conflict with these Terms, the Supplementary Terms will prevail for that service.
1.5These Terms are the entire agreement between you and us about their subject matter and replace any prior agreements, representations or understandings about the Services. If you breach these Terms, we may take action against you, including suspending or terminating your access to the Services. Wherever these Terms use the word “include” or “including”, what follows is a set of examples and not an exhaustive list.
1.6These Terms and all related documents, information and notices are provided in English. If a translation conflicts with the English version, the English version prevails to the extent permitted by law.
2. Privacy
2.1We handle the information you provide in accordance with our Privacy Policy, which explains how we use and protect your personal data when you use the Services. By using the Services you acknowledge that your data will be processed as described there.
2.2You may close your account at any time using the options provided in the Services or by contacting us. When your account is closed, we will remove the personal data associated with it from our active systems, except where we must keep certain information to meet legal or regulatory obligations.
3. Age of users
3.1Minimum age. Children aged 12 and under may not use the Services.
3.2If you are over 12 but under 18 (or under the age of legal majority where you live), you may use the Services only under the supervision of a parent or legal guardian who also agrees to these Terms. Parents and legal guardians are fully responsible for a minor’s use of the Services, including any in-app purchases. If your child is 12 or younger, or otherwise not ready to use the Services in your judgement, you must not allow them to use the Services. You are responsible for making sure your child understands these Terms and how to behave towards others when using the Services.
3.3Except as permitted under Section 3.2, you confirm that you are at least 18 years old (or the age of legal majority where you live) and have the legal capacity to agree to these Terms. We may terminate your access immediately and without notice if we determine or reasonably suspect that you do not meet these age requirements.
4. Accounts and security
4.1When you register for an account, you must provide accurate, complete and current information and keep it up to date. We may decide at our discretion whether to accept a registration.
4.2You are responsible for keeping your login details safe and must tell us immediately about any unauthorised access. You must not share your account or use anyone else’s account, and you must not request, collect or use other users’ login details. You are responsible for all activity under your account, including all purchases. We are not liable for any loss or damage arising from the use of the Services by you or any third party, with or without your permission.
4.3If your account information is inaccurate, or if you breach these Terms, we may suspend or terminate your account immediately.
4.4By registering for an account and using the Services, you confirm that all information you provide is true, accurate, current and complete, and that you have the legal capacity and authority to accept and comply with these Terms.
5. User content and conduct
5.1The Services may let you and other users create, post, store or share content such as reviews, messages, text, images, photos, videos and other material (“User Content”). Depending on your settings, your User Content and related information (such as your user ID, name and profile picture) may be visible to others. You alone are responsible for your User Content and the consequences of sharing it.
5.2You must not behave in a way that (i) infringes the intellectual property or other rights of others; (ii) is unlawful, misleading or fraudulent; (iii) is abusive, obscene or offensive; or (iv) disrupts the operation of the Services. Section 6 sets out a full list of prohibited activities.
5.3We do not review all User Content, but we may remove or disable access to any content that we decide, at our discretion, breaches these Terms.
5.4Any feedback, ideas or suggestions you give us about the Services (“Feedback”) are non-confidential and become our exclusive property. You grant us a worldwide, perpetual, irrevocable, royalty-free licence to use, copy, modify, distribute and otherwise exploit Feedback for any purpose, without any obligation to compensate you.
6. Your obligations
6.1You agree that you will not:
- post, upload, publish or transmit any User Content that: (i) infringes or misappropriates any patent, copyright, trademark, trade secret, moral right or other intellectual property right, or any right of publicity or privacy; (ii) breaks, or encourages breaking, any law or would create civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any person or group; (vi) is violent or threatening, or promotes violence or threats against anyone; (vii) promotes illegal or harmful activities or substances; or (viii) contains another person’s private or personal information without their consent;
- create multiple accounts or impersonate anyone;
- use, display, mirror, scrape, copy, index or frame the Services or any part of them, our name, trademarks, logos or other proprietary information, or the layout and design of any page, without our prior written consent;
- exploit, share or promote bugs, glitches, errors or technical issues that could give an unintended advantage, such as repeatedly claiming one-time promotions;
- create or use cheats, exploits, mods, hacks, bots or any unauthorised third-party software designed to modify or interfere with the Services or anyone’s experience of them;
- use any payment card in connection with the Services without the cardholder’s permission;
- access, tamper with or use non-public areas of the Services, our computer systems or the technical delivery systems of our providers;
- probe, scan or test the vulnerability of any of our systems or networks, or breach any security or authentication measures;
- avoid, bypass, remove, disable, impair, descramble or otherwise circumvent any technological measure used by us, our providers or any third party (including another user) to protect the Services;
- access, search or download content from the Services using any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers or data-mining tools) other than the software we provide or generally available web browsers;
- send unsolicited advertising, promotional material, spam, chain letters or any other form of solicitation;
- use the Services, or any part of them, for commercial purposes or for the benefit of any third party, or in any way not permitted by these Terms;
- decompile, disassemble, reverse engineer or attempt to derive the source code of any software used to provide the Services;
- interfere with, or attempt to interfere with, the access of any user, host or network, including by sending viruses, overloading, flooding, spamming or mail-bombing the Services;
- collect or store personal information about other users without their express permission;
- impersonate or misrepresent your affiliation with any person or entity;
- break any applicable law or regulation; or
- encourage or help anyone else to do any of the above.
6.2We are not obliged to monitor the Services or review content, but we may do so to operate the Services, enforce these Terms and comply with the law. We may remove or disable access to any content, including User Content, at any time and without notice if we consider it objectionable or in breach of these Terms. We may investigate breaches of these Terms and cooperate with law enforcement authorities. You are solely responsible for your interactions with other users; we are not responsible for those interactions and are not a party to disputes between users.
6.3You must comply with all applicable local, national and international laws and regulations when using the Services.
7. Virtual items
7.1The Services may give you access to in-game currency, such as coins, gems, points, credits or bonuses (“Credits”), and other virtual items or collections (together with Credits, “Virtual Items”). Virtual Items are part of the Services and are licensed, not sold, to you under Section 8.2, solely for use within the Games. They have no real-world monetary value and can only be obtained through the Services. For example:
- you may receive a licence to Virtual Items through gameplay or promotions (for example, a number of Credits awarded at regular intervals); or
- you may have the opportunity to purchase a licence to Virtual Items.
Your use of Virtual Items is subject to the licence in Section 8.2 and the restrictions in Section 6 and elsewhere in these Terms. Unless we say otherwise, Virtual Items can only be used in the Game in which you obtained them and according to that Game’s rules. You do not own Virtual Items and have no rights in them other than this licence. To the fullest extent permitted by law, we retain all rights, title and interest in Virtual Items. Virtual Items are not prepaid payment instruments, have no equivalent real-world value and can never be redeemed or exchanged for real money, goods or anything else of monetary value, from us or anyone else.
7.2Prices and availability of Virtual Items may change without notice, and we may refuse any request to purchase or obtain Virtual Items for any reason. The features, content and capabilities of Virtual Items may also change at any time, with or without notice and without liability to you.
7.3You may not transfer, sell, resell, trade, lend or gift Virtual Items except where the Services expressly allow it. This means, for example, that you may not buy, sell or trade Virtual Items on any other platform or marketplace. We are not liable for any claims or losses arising from unauthorised transactions involving Virtual Items.
7.4Purchases of Virtual Items are processed by third-party Platform Providers (as defined in Section 9.2). Refunds and disputes for purchases made through a Platform Provider must be handled directly with that Platform Provider under its own policies.
8. Intellectual property
8.1The Services and all of their content are protected by copyright and other intellectual property laws. Except as expressly set out in these Terms, we do not grant you any express or implied right or licence under any patent, copyright, trademark or trade secret. The Services and everything in them, including games, applications, titles, computer code, themes, objects, characters, names, dialogue, catchphrases, concepts, artwork, animations, sounds, music, audio-visual effects, documentation, in-game chat transcripts, Virtual Items, videos, photos, advertising, images, text, designs, user profiles, gameplay mechanics, features, interfaces, server software, metadata, logos, trademarks, service marks, domain names, trade names, source and object code, and the structure and organisation of the Services, are owned by or licensed to Underdog and are protected by law, whether registered or not.
8.2Provided you comply with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Services for your own personal, non-commercial entertainment. Any other use is strictly prohibited and will end this licence automatically.
8.3Any infringement of our intellectual property rights may lead to immediate termination of your access to the Services and to civil, criminal or injunctive remedies. We may take legal action, including claims for damages and legal costs, and may report infringements to the relevant authorities.
9. Payment
9.1Depending on where you live, and always in line with applicable law, prices shown in the Services may include or exclude applicable taxes. Taxes will be shown at checkout so you can review them before confirming your purchase. Prices may change at any time without notice.
9.2Purchases made through a third-party platform, such as the Apple App Store, Google Play or another website or app store (each a “Platform Provider”), may also be subject to that Platform Provider’s own terms and policies. Any agreement you make with a Platform Provider is between you and that Platform Provider; we are not a party to it.
9.3You must pay all charges incurred by you or on your behalf through the Services, at the prices in effect when the charges are incurred, including applicable taxes. If we need to take legal action to collect amounts owed, you will reimburse us and our vendors and agents for the costs of collection, including legal fees.
9.4We may decline or cancel an order in certain cases, for example if your payment method is declined, if we suspect fraud, or in other circumstances at our discretion. We may also limit quantities of Virtual Items, delay delivery after an order has been accepted, or refuse to deliver Virtual Items for any reason.
9.5You agree to pay the fees shown in the Services. We may change these fees at any time at our discretion.
9.6All payments are non-refundable to the fullest extent permitted by law. If you were charged for a transaction you did not make, did not receive Virtual Items you paid for, or were charged an incorrect amount for a purchase made directly with us, you may request a refund or correction at contact@underdog.gs. For purchases made through a Platform Provider, that Platform Provider is responsible for refunds under its own policies.
9.7Except where applicable law provides otherwise, you will not receive a refund or any compensation for unused Virtual Items if the Services are discontinued for any reason, or if we suspend or terminate your access to the Services.
10. Chance-based features and gameplay mechanics
10.1Some Games may include features whose outcomes are determined by a pseudo-random number generator, such as randomised rewards or surprise drops. These features exist purely for entertainment. Nothing of real-world value is wagered, staked or won through them.
10.2To improve the player experience, the Games may use dynamic, algorithm-based adjustments to gameplay at our discretion.
10.3The Games do not offer real-money gambling or any opportunity to win real-world money or prizes. All chance-based and dynamic features are for entertainment only. By using the Services you agree that these features are not gambling and that no real-world financial benefit can be obtained from them.
11. Repeat infringers and content complaints
11.1Where appropriate, we terminate the accounts of users who repeatedly infringe the intellectual property rights of others. If you believe content in the Services infringes a copyright you own or control, or otherwise breaches these Terms, please contact us:
Underdog Studios Oyun Teknolojileri A.Ş.
Ehlibeyt Mah. Tekstilciler Cad. No: 35 İç Kapı No: 7, 06520 Çankaya / Ankara, Türkiye contact@underdog.gs12. Indemnification
12.1You agree to indemnify and hold harmless Underdog and its directors, managers, officers and employees from all claims, demands, actions, damages, losses, costs and expenses, including reasonable legal fees, arising out of or relating to: (i) your use of the Services; (ii) your breach of these Terms or any other policy; (iii) Feedback or submissions you provide; (iv) false, incomplete or misleading information you provide to us; (v) your violation of the rights of any other person or entity; or (vi) any content, including User Content, that you provide, upload or transmit through the Games.
12.2Except as set out in these Terms, all warranties, indemnities and representations, express or implied, are excluded to the fullest extent permitted by law. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
13. Limitation of liability
13.1Because the laws of the European Economic Area, the United Kingdom and Switzerland (together, “EEA+”) differ from those of other places, Section 13.2 applies only if you are located in the EEA+, and Section 13.4 applies only if you are located outside the EEA+.
A. If you are located in the EEA+
13.2Provided we have acted with professional diligence, we are only responsible for loss or damage that is (i) caused by our breach of these Terms, or (ii) reasonably foreseeable when these Terms were entered into. Nothing in these Terms excludes or limits our liability for death or personal injury, fraud, fraudulent misrepresentation or any other liability that cannot be excluded by law.
If we suspect that you have breached these Terms, we may investigate and, while we do so, suspend your access to the Services, acting reasonably and proportionately and only as permitted by law. We may then suspend or terminate your access if: (i) we determine, reasonably and objectively, that you have materially or repeatedly breached these Terms; (ii) we have objective grounds to believe you are about to seriously breach them; (iii) we are legally required to; or (iv) we have objective grounds to believe it is necessary to address a serious technical or security issue. If you believe we have suspended or terminated your access by mistake, you can appeal by writing to us at the address in Section 11, and we will review our decision.
13.3If you live in an EEA country: (i) you have a statutory right to withdraw from these Terms within 14 days of accepting them; and (ii) the Services may be covered by the statutory guarantee of conformity under Directive (EU) 2019/770, as implemented where you live, for as long as we provide the Services to you. We will inform you of and provide updates, including security updates, needed to keep the Services in conformity, and we strongly recommend installing them promptly, as failing to do so may affect how the Services work. If you notice a lack of conformity, please notify us at the address in Section 11. We will review your complaint and try to restore conformity, free of charge, within a reasonable time. If we cannot do so, we will let you know, and you may choose to terminate these Terms and stop using the Services.
B. If you are located outside the EEA+
13.4To the maximum extent permitted by applicable law, neither Underdog nor its directors, officers or service providers will be liable for any indirect, incidental, consequential or special damages arising out of or in connection with these Terms or the use of the Services, even if advised of the possibility of such damages. Our total liability will not exceed the amounts you paid for the Services in the 12 months before the claim arose, or USD 100 if you have paid nothing.
13.5Nothing in these Terms (i) limits or excludes any non-waivable rights you may have under consumer protection laws in the United States, the United Kingdom or any other jurisdiction, or (ii) excludes or limits liability for gross negligence, wilful misconduct or any other liability that cannot be excluded by law.
14. Disclaimer
14.1You use the Services and any content or materials in them at your own risk. Except as otherwise stated in these Terms, and to the fullest extent permitted by law:
- the Services and all content and materials provided in or with them are provided “as is” and “as available”, without warranties of any kind, express or implied; and
- we disclaim all warranties relating to them, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
14.2We do not promise that the Services will be continuously available, uninterrupted, timely or error-free.
14.3We do not guarantee that the Games will not cause damage to your device or operating system. You accept the entire risk as to the quality and performance of the Services and their content.
14.4Underdog does not endorse or encourage gambling in any form. Any game features that involve chance are for entertainment only and are not gambling or wagering. Taking part in them does not lead to any real-world financial gain or loss, and you should not treat them as a way to gamble or expect any monetary reward. By using the Services you acknowledge that we do not promote or support gambling, that you are responsible for your own actions while playing, and that you choose to play of your own free will.
15. Confidentiality
15.1“Confidential Information” means all information disclosed to you or obtained by you, directly or indirectly, from Underdog, whether written, oral, graphic or machine-readable and whether or not marked as confidential, including analyses, software, financial and legal information, business plans, projects, operations, copyrights, patents, trade secrets, ideas, inventions, innovations, databases, computer programs and their documentation, encryption techniques, processes, advertising and marketing plans, product and technical plans, business strategies, strategic alliances, partner information, engineering data, game designs and specifications.
15.2You agree to keep all Confidential Information strictly confidential and not to disclose it to any person or entity.
16. Governing law and jurisdiction
16.1These Terms, and any dispute relating to them, are governed by the substantive laws of the Republic of Türkiye, without regard to its conflict-of-laws rules. Except as set out in Section 17, the courts and enforcement offices of Ankara (Central) have exclusive jurisdiction over any Dispute (as defined below) that is not subject to arbitration, and you and Underdog each waive any objection to jurisdiction and venue in those courts.
17. Dispute resolution and agreement to arbitrate
Please read this section carefully. It requires you and Underdog to resolve most disputes through individual arbitration, limits how each of us can seek relief, and includes a waiver of class actions and jury trials.
This section is intended to reduce the cost of resolving disputes, not to delay the resolution of your claims. If you live in the United Kingdom or the European Economic Area, nothing in this Section 17 excludes or restricts any statutory consumer rights you have under the laws of your country of residence.
17.1You and Underdog agree that all past, present and future disputes, claims or causes of action between you and Underdog (including non-contractual ones) arising out of or relating to these Terms, the Services, the formation of these Terms, or any other dispute between you and Underdog or any of our licensors, distributors, suppliers or agents, whether arising before or after you agreed to this section (each a “Dispute”), will be resolved under the procedure below. Disputes may not proceed, in court or in arbitration, as a class, group, mass or representative action.
Informal dispute resolution
17.2Before starting any formal proceedings, you and Underdog will first try to resolve any Dispute informally. For 60 days after one party receives a written notice of the Dispute from the other (a “Dispute Notice”), or longer if both parties agree in writing (email is sufficient) (the “Informal Resolution Period”), both parties will negotiate in good faith.
You must send any Dispute Notice to contact@underdog.gs. We will send any Dispute Notice to you using the contact details you have given us. A Dispute Notice must (i) include the sender’s name, postal address, email address and telephone number (for you, those linked to your account); (ii) describe the factual and legal basis of the Dispute in reasonable detail; and (iii) describe the relief sought, including a good-faith calculation of any damages claimed. A Dispute Notice is only valid if it relates to, and is sent on behalf of, one individual party.
The Informal Resolution Period gives the party receiving a Dispute Notice a fair chance to make a settlement offer. Neither party may start arbitration or (where permitted) court proceedings before it ends. During this period, both parties will try to meet personally, by telephone or video call, to resolve the Dispute in good faith. Lawyers may join, but the parties must also take part. If the Dispute is not resolved within the Informal Resolution Period, either party may start arbitration or, where permitted, court proceedings as described below. If a party fails to send a Dispute Notice and wait for the end of the Informal Resolution Period, the other party may seek immediate dismissal of the proceedings and recovery of its costs. Settlement offers made during this period may not be disclosed to the arbitrators or court until they have decided any award.
Agreement to arbitrate
17.3You and Underdog agree to resolve any Dispute not settled during the Informal Resolution Period through final and binding arbitration, except as otherwise required by law or as set out in Sections 17.4 and 17.6.
Opting out
17.4You may opt out of this agreement to arbitrate by emailing a notice to contact@underdog.gs within 30 days of first accepting these Terms. Your notice must be in writing, state your first and last name and that you decline this arbitration agreement, and be personally signed and dated by you. You may attach it as a PDF, photo or in any other format that clearly shows this information. Opting out does not affect your ability to use the Services, and neither you nor Underdog will be required to arbitrate Disputes; however, the other limitations that apply to litigation will continue to apply to both of us. If you were already bound by an earlier agreement to arbitrate with us when you received these Terms, that earlier arbitration agreement (but not the rest of the earlier terms) will continue to apply to you.
Arbitration procedure and fees
17.5The arbitration will be administered by the Istanbul Arbitration Centre (“ISTAC”) under its rules in force when the arbitration is started. You agree that this is an international arbitration agreement relating to more than one jurisdiction within the meaning of Article 3 of the Turkish International Arbitration Law (Law No. 4686). The ISTAC rules are available at istac.org.tr. The seat of arbitration will be Ankara, Türkiye, unless you choose to have the proceedings conducted by telephone, video or other remote means. The arbitration will be conducted in English by three arbitrators. Each party will appoint one arbitrator, and the two party-appointed arbitrators will nominate the third, who will chair the tribunal. If they fail to do so, the ISTAC Arbitration Court will appoint the chair. Arbitration fees will be governed by the ISTAC rules.
You and Underdog agree that (A) the arbitrators are bound by these Terms; (B) the arbitrators have exclusive authority to decide questions of arbitrability; and (C) all arbitration proceedings and awards are confidential. An award may only be disclosed to a party’s legal, accounting or financial advisers (who are bound by the same confidentiality), except (i) where necessary to pursue or defend legal rights in other proceedings; (ii) in connection with confirming, enforcing or recognising the award; or (iii) as otherwise required or permitted by law.
To the maximum extent permitted by law, neither you nor Underdog may: consolidate, join or coordinate Disputes with those of other people; take part in any collective, group, class or mass arbitration or litigation; bring a Dispute in a representative capacity, including as a member of a class, or in a private attorney general capacity; or seek recovery of losses suffered by third parties. All such rights are expressly and unconditionally waived. Any challenge to the validity or enforceability of this paragraph will be decided exclusively by the arbitrators.
Exceptions
17.6Despite the agreement to arbitrate:
- if you are located in the EEA+, either party may instead bring qualifying claims through the relevant claims procedure in the courts of your country of residence; and
- if you are located outside the EEA+, either party may bring qualifying claims in the small-claims courts of Ankara, Türkiye or, if a court in your country of residence would not recognise this requirement, in a small-claims court or equivalent in your country of residence.
18. Termination
18.1The rights granted to you under these Terms end immediately if you breach these Terms or any other agreement with us. We may, at our discretion, suspend or terminate your access to the Services at any time and for any reason, without notice or liability. We are not liable to you or any third party for any suspension or termination of your access to the Services.
19. Third-party links and content
19.1We make no representations about, and accept no responsibility for, the quality, content, nature or reliability of websites linked from the Games or that link to the Games. Linked sites are not under our control, and we are not responsible for their content, links, reviews, changes or updates. Including a link does not imply any affiliation with, endorsement of or adoption of the linked site or its content. When you leave the Games for another site, these Terms no longer apply, and your dealings with that third party are solely between you and them. We are not liable for any loss or damage arising from such dealings, and you use third-party content at your own risk.
20. Miscellaneous
20.1Force majeure. Neither you nor Underdog will be in breach of these Terms, or liable for any loss or damage, if delayed or prevented from performing them by a Force Majeure Event. A “Force Majeure Event” is any event beyond a party’s reasonable control, including pandemics, floods, extreme weather, earthquakes, fires, war, insurrection, riots, labour disputes, accidents, government action, communications or power failures, bank failures, and equipment or software malfunctions, including unexpected changes to networks the Services rely on.
20.2Responsible play. We want you to have a fun and entertaining experience with the Services, but you are responsible for managing your own playtime and spending.
20.3Beta features. We may sometimes offer features in beta or testing phases. These are provided “as is” without any warranty, and may change or be withdrawn without notice.
20.4Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. A court of competent jurisdiction may modify an unenforceable provision to the extent necessary to make it enforceable, and these Terms will be interpreted, where possible, to preserve their legality and enforceability.
20.5Assignment. These Terms bind your successors, heirs, personal representatives and permitted assigns. You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent, which we may withhold at our discretion. We may assign our rights or delegate our obligations under these Terms at our discretion.
20.6Waiver. A party’s failure to enforce any provision does not affect its right to enforce it later. A waiver of any breach does not waive any later breach or the provision itself.
20.7Evidence. To the extent permitted by law, you agree that our books, records, documents, invoices, transaction receipts, communications, notices, reports, records of internet and electronic transactions, and voice and video recordings relating to orders and instructions given through any channel will constitute conclusive evidence under Article 193 of the Turkish Code of Civil Procedure. You agree that communications by phone, internet or interactive systems may be recorded, and that we may provide such records to competent legal and administrative authorities upon request.
20.8Relationship of the parties. Nothing in these Terms creates any partnership, joint venture, agency, consultancy or trust relationship. You and Underdog are independent parties.
20.9Electronic communications. By accepting these Terms, you consent to receive all communications, agreements, documents, receipts, notices and disclosures (“Communications”) from us electronically, either through the Services or by email to the address you provided. You are responsible for keeping your contact details up to date. If we send a Communication electronically and you do not receive it because your contact details are incorrect or out of date, it is blocked or marked as spam, or you are otherwise unable to receive electronic Communications, we will be deemed to have delivered it. Marketing communications will be sent in accordance with applicable law and our Privacy Policy.
20.10Changes to the Services. We may modify, suspend or discontinue all or part of the Services, temporarily or permanently, at any time, with or without notice. We are not liable for any such modification, suspension or discontinuation.
20.11Technical requirements and updates. Your use of the Services depends on your device meeting the necessary hardware, software and internet connectivity requirements, which you are responsible for. We may require you to install updates to the software or Services for compatibility, security or performance reasons.
